What you need to know about software titles with resell rights.

Even though software titles with resale rights may seem like a very easy way to make money, there are also very easy ways to lose money with them too. Money truly is the root of all evil, and software companies will do everything they can to protect their profits, right down to the letter.
 
One of the best ways to protect yourself is to read everything they give you with the software, but that only applies to software titles with resale rights already built and on the market. Even if you are reselling software that is already made, you still have to be careful of the exact same things you would if you made it yourself – especially if the software producer is less than diligent.
 
All kinds of intellectual property can have copyrights and patents, including software titles with resale rights – or any part of the program, for that matter. No matter how small of a portion the code may be, it could already have a copyright, which means you would need a license from the programmer who originally made and copyrighted it, in order to legally use it for profit.
 
Even large software producers can get into trouble if they do not check their code against a patent and licensing database. Some software producers will check their software titles with resale rights for patent violations, and still put it out on the market with this knowledge. Worse yet, they will "inform you" of this patent violation in their agreement with you.
 
The problem with that is most people who resell software programs with resale rights focus on getting as many income streams as they can, and never read their agreements. The problem with this is two fold. For one you will not know if you end up operating outside of that agreement, leaving you wide open to be caught with your pants down.
 
Even worse, if you "know" about a licensing violation, you will have an even greater penalty glaring you in the face. You cannot claim ignorance on something that you legally agreed to. If the details of your licensing violation are spelled out in your agreement, the court will not hesitate to penalize you to the fullest extent – possibly putting you out of business, and permanently scarring your good name.
 
So protect yourself – read everything you agree to, and make sure that any software you produce is not violating any copyrights. It may be painful pouring through all of that information, but I'm sure going out of business because you did not, would be even more painful.
